The rules of the run.

1. Acceptance and eligibility

By creating an account, buying access, or using The 90, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old and legally able to enter this agreement. If local law requires a higher age, that age applies. A parent or legal guardian must approve use when required by law.

2. Your account

Provide accurate information, keep your sign-in links and devices secure, and notify us promptly of suspected unauthorized access. You are responsible for activity through your account unless applicable law says otherwise.

One person may not impersonate another, create accounts to evade restrictions, or access another member’s private run or Party data without permission.

3. Subscriptions, renewal, and refunds

Paid access is sold through Apple’s App Store. The price and billing period appear in Apple’s purchase sheet before you confirm. Unless canceled, an auto-renewing subscription renews through your Apple Account according to Apple’s terms.

• Manage or cancel in Apple subscription settings.
• Use Restore Purchases in the app to restore an eligible entitlement.
• Refund eligibility and processing are controlled by Apple. Requests can be made at Report a Problem.
• Deleting your The 90 account or deleting the app does not cancel an Apple subscription.

Features, pricing, and availability may change prospectively. We will provide notice where required by law.

4. Physical and personal safety

The 90 is a lifestyle challenge, not medical, mental-health, nutrition, or professional advice. Results are not guaranteed. You are responsible for deciding whether an action is appropriate for your health, ability, environment, and circumstances.

Use available substitutions, follow clinician-provided limits, and stop for pain, dizziness, faintness, chest pressure, severe shortness of breath, or another concerning symptom. Seek emergency help when appropriate. Read the Safety Guide before beginning.

5. Party, invitations, pokes, and sharing

Party is optional. Members advance independently and may see approved leaderboard information about one another. Treat members respectfully, do not pressure anyone to reveal sensitive information or complete an unsafe action, and do not misuse pokes or invitations to harass others.

You control where you send a share card or invite code through the iOS share sheet. Do not share someone else’s personal information without permission. Anyone who obtains a still-valid invite code may attempt to use it.

6. Acceptable use

You may not:

• Break the law, threaten safety, harass others, or upload unlawful or infringing content.
• Probe, bypass, disrupt, overload, scrape, reverse engineer, or gain unauthorized access to the service except where law expressly permits.
• Manipulate purchases, rankings, progress, invitations, analytics, or entitlement systems.
• Use automated accounts, malware, credential theft, deceptive links, or the service to distribute spam.
• Copy or commercially exploit app content, artwork, brands, or software without permission.

7. Content and intellectual property

The app, website, code, visual design, quests, boss characters, logos, text, and other materials are owned by or licensed to The 90 and protected by applicable law. These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the service as intended.

You retain rights in content you submit. You give us a limited license to host, process, reproduce, and display that content only as needed to operate, secure, support, and improve the service. A destination you choose for sharing may require its own license under its terms.

If you send feedback, you allow us to use it without payment or obligation, provided we do not publicly identify you without permission.

8. Availability, third parties, and disclaimers

The service is provided “as is” and “as available” to the fullest extent permitted by law. We do not promise uninterrupted access, error-free operation, specific outcomes, or that every quest is suitable for every person.

Apple, Supabase, RevenueCat, PostHog, Expo, email providers, websites, and share destinations are third-party services governed by their own terms. We are not responsible for third-party services beyond the extent required by law.

To the fullest extent permitted by law, The 90 and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, lost profits, or loss of goodwill arising from the service. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

9. Suspension, deletion, and changes

You may stop using the service at any time and can delete your account under Settings → Delete account. We may limit or suspend access when reasonably necessary to protect users or the service, investigate misuse, comply with law, or enforce these Terms. Where practical and lawful, we will give notice and a chance to appeal.

We may update these Terms as the service or law changes. The revised effective date will be posted here, with additional notice for material changes where required. Continuing to use the service after revised Terms take effect means you accept them, unless law requires another form of consent.

10. Governing terms

These Terms are governed by applicable United States law, without overriding mandatory consumer protections in your home jurisdiction. If any provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver.
